Presuming Equal Parenting Time When Both Parents Are Fit • Introduced February 2026

What AB 1978 Does

For custody cases filed on or after January 1, 2027, this bill creates a rebuttable presumption that equal parenting time (50/50 custody) is in the child's best interest — provided both parents are fit, willing, able, and live within 25 miles of the child's school.
